None for respondents No.2(a), 2(c) to 2(e)and 3 to 13. CMP(M) No.1452 of 2025 Heard counsel for the parties and perused the pleadings. From perusal of the application, it is evident that appellant No.1 had died on 18.09.2024. The right to sue survives in the legal heirs of deceased appellant No.1, detailed in Paragraph-2 of the application. However, in terms of the Will executed by deceased appellant No.1, right to sue survives only with legal heir-Gyan Chand, in whose favour the Will has been executed by the deceased appellant. On the basis of the Will, mutation of inheritance is stated to have been attested. In view of the facts and attending circumstances of the case, legal heir- Gyan Chand is ordered to be arrayed as the sole surviving legal heir of deceased appellant No.1-Krishnu Ram, subject to just all exceptions.
