WRIT PETITION NO. 20687 of 2025 ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 4 and 5 in insisting petitioners to vacate from their agricultural landed property admeasuring an extent of Ac. 1.36 cents in Sy.No.961 of Chinna Cheppali Revenue Village in Kamalapuram Mandal of Y.S.R. Kadapa District at the instance of local political leaders under the guise of notice in Rc.No.B/95/2025, dated 01.04.2025, without following due process as mandated by law, as illegal, irregular, irrational, without jurisdiction and violative of principles of Natural Justice and offends Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents not to interfere in any manner with petitioners possession and enjoyment of aforesaid lands and pass such other order or orders as this Court may deem fit and proper in the circumstances of the case”. 2. Learned Assistant Government Pleader for Revenue, on instructions, submits that the respondents will follow the due procedure while dispossess of the petitioner from the subject property. 3. In view of the above said submission, this Court deems it appropriate to dispose of this writ petition with a direction to the respondents to examine the explanation submitted by the petitioner to the impugned notice, dated 02.04.2025 and pass appropriate orders in accordance with law and communicate the said decision to the petitioner herein. Till such time, no coercive steps shall be taken by the respondents against the subject property. 4
