The instant application under Section 528 BNSS has been filed to direct the Civil Judge (Senior Division)/ F.T.C. No.2, Hathras to conclude the trial of Complaint Case No.114/12.2023, under Sections 12, 18, 19, 20, 21, 22 of Domestic Violence Act, Police Station- Mahila Thana, District Hathras. 3. At the very outset, learned counsel for the applicant submits that he has made incorrect prayer to expedite the proceeding under Domestic Violence Act though he wants to challenge the proceeding under Domestic Violence Act. Therefore, he may be permitted to withdraw the present application with liberty to file an application under Section 528 BNSS to challenge the proceeding under Domestic Violence Act. 4. Learned AGA has no objection. 5. In view of above, the present application is dismissed as withdrawn with the aforesaid liberty. 6.
