Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ / Order direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents No. 3, 4 and 5 and the staff of Circle Inspector of Police, Polavaram and Koylagudam Police Station, West Godavari District in calling the petitioner to police station frequently without any complaint and further interfering with civil disputes and also attempts to convert the civil disputes into criminal case which is highly illegal arbitrary and violation of Article 14 and 21 of the Constitution of India and consequently direct the respondents not to call the petitioner to Police Station and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to call the petitioner to Police Station frequently without out any complaint or without following the due procedure as settled principals of law pending disposal of the above writ petition and pass Counsel for the Petitioner:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue an appropriate Writ / Order direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents Nos. 3, 4 and 5 and the staff of Circle Inspector of Police, Polavaram and Koylagudam Police Station, West Godavari District in calling the petitioner to police station frequently without any complaint and further interfering with civil disputes and also attempts to convert the civil disputes into criminal case which is highly illegal, arbitrary and violation of Article 14 and 21 of the Constitution of India and consequently direct the respondents not to call the petitioner to Police Station and pass…”

When the matter is taken up for hearing, Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that the petitioner has submitted a petition before the Public Grievance Redressal System and to enquire into the matter, the petitioner was called to the police station. No crime is registered against the petitioner.

Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of.
4. Recording the above said submission, the Writ Petition is disposed of. No order as to costs. However, the police are directed to follow due process of law.
