Heard Mr. Aditya Gupta, learned counsel for the petitioner, learned A.G.A. for the State-respondents and perused the material brought on the record. 2. The relief sought in this petition is for quashing of the F.I.R. dated 04.1.2024 registered as Case Crime No.0012 of 2024, under Section 8/20 of the N.D.P.S. Act-1985, P.S. - Baradari, District- Bareilly. Further prayer has been made not to arrest the petitioner in the aforesaid case. 3. After substantial arguments, once the Court has declined to accord interim relief in favour of the petitioners as well as to quash the impugned F.I.R. on the premise that petitioner is having two criminal antecedents to his credit under the N.D.P.S. Act and though in both of the cases, he has already been enlarged on bail by learned Single Judge of this Court vide its judgments and orders dated 21.5.2018 and 5.8.2024, respectively, passed in Criminal Misc. Bail Application No. - 9169 of 2018 and Criminal Misc. Bail Application No. - 21375 of 2024, respectively, learned counsel for the petitioner very fairly conceded the fact that he does not want to press the instant petition and the same may be dismissed as not pressed. However, lave may be accorded to the petitioner to move application for bail/anticipatory bail before the appropriate forum. 4. Learned A.G.A. for the State-respondents is having no objection to the same. 5. In view of the above, the writ petition stands dismissed as not pressed with the liberty as prayed for.
