(Accused Petitioner Presently Confined In District Jail Baran) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Vikram Singh, Adv. For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 25/08/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.56/2025, registered at Police Station Pali, District Baran, for the offence(s) under Sections 318(4), 61(2) of BNS and Section 3 and 7 of Essential Commodities Act and Section 19 of the Fertilizer (Control) Act. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that the adulterated manure was recovered from the other co- accused Dilraj Meena. It is also alleged against the petitioner that he sold and supplied the said adulterated manure to co-accused Dilraj Meena, there is no substantive evidence available on record indicating involvement of the petitioner in the alleged crime and there are no criminal antecedents against the accused-petitioner. [2025:RJ-JP:33646] (2 of 2) [CRLMB-10639/2025] It is further argued that the accused-petitioner is in custody since 01.08.2025 and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. 4. Heard and perused the material available on the record. 5. The main allegation of possessing the adulterated manure (fertilizer) is against the co-accused Dilraj Meena, the accused- petitioner is in custody since 01.08.2025 and the matter is exclusively triable by Magistrate and trial of the case may take considerable time, therefore, without commenting anything on the merits of the case, this Court deems it proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused petitioner- Krishna Sharma S/o Lalaram, in connection with FIR No.56/2025, registered at Police Station Pali, District Baran, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
