2.
Brief facts of the case are that the petitioners have taken admission in the B.Sc. (Hons) Agriculture Course with the respondent-university, the said course was of four years duration divided into eight semester. During continuance of said course, the petitioners applied and were appointed on the post of Agriculture Supervisor vide order dated 11.03.2022, thereafter, the petitioners applied for temporary withdrawal of the course from the respondent-university. In response of the said application, the respondent-university cancelled the registration of the petitioners vide order dated 05.04.2022 and that point of time, the petitioners cleared five semesters. The petitioners have challenged the order dated 05.04.2022 on the ground that the respondents earlier permitted the students for temporary withdrawal from the course, as per the prospectus issued by the respondent-university for 2017-2018.
3. Counsel for the respondents submits that as per Clause 4.3.4 of the general information issued by the respondents with their prospectus for the years 2017-2018, no student shall be entitled to join more than one programme of study, concurrently and prayed for dismissal of the writ petition.
4. Counsel for the petitioners in rejoinder submits that Clause 4.3.4 is not applicable upon the petitioners as the petitioners have not joined for more than one programme of study concurrently whereas the petitioners have joined the government service. Earlier also the respondents have permitted Sh. Ramesh Kumar for temporary withdrawal from the course vide their order dated24.08.2020.
(3 of 3) [CW-15965/2023]
5. Heard counsel for the parties and perused the record.
6. This writ petition filed by the petitioners deserves to be allowed for the reasons; firstly, the petitioners are entitled for temporary withdrawal from the course as per Clause 4.3.4 of the general information issued by the respondents with their prospectus for the years 2017-2018 which prohibits joining of two parallel course of study by the students whereas in the present matter, the petitioners have not joined any two programme for study, concurrently whereas the petitioners have joined the government service after selected by the State Government.
7. In that view of the matter, this writ petition stands allowed. The order passed by the respondent-University dated 05.04.2022 is quashed and set aside. The respondents are directed to allow the petitioners to complete the course in which they were given admission.
