Neutral Citation No. - 2025:AHC:41025 Court No. - 5 Case :- WRIT - C No. - 7276 of 2025 Petitioner :- Nasarin Fatima Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Gokaran Singh Counsel for Respondent :- C.S.C. Hon'ble Dr. Yogendra Kumar Srivastava,J. The present petition has been filed seeking a direction to respondent No. 2, the Tehsildar, Tehsil Ghosi, District Mau to decide the Restoration Application dated 06.09.2024, which is pending in Case No. 1432 of 2022 (Computerized Case No. T202215510201432) [Nasarin Fatima Vs. Husn Ara], under Section 34 of the U.P. Revenue Code, 2006, within a stipulated time period. From the record, it reflects that for recall of the order dated 31.10.2023, in terms of which the case was dismissed for non prosecution, a restoration application was moved on 06.09.2024. The order sheet of the case, a copy whereof has also been appended to the writ petition indicates that after filing of the restoration application, although several dates have been fixed, but the matter is being adjourned for some reason or the other. Accordingly, the petitioner, by way of the present petition, has sought the proceedings to be concluded expeditiously. Learned Standing Counsel appearing for the State-Respondent(s) has no objection if the proceedings are expedited. Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present petition is disposed of with an observation that the court concerned would make an endeavor to decide the restoration application and also the case itself, in accordance with law, expeditiously preferably within a period of three months from the date of production of certified copy of the instant order, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
