(Oral) This petition has been filed under Section 528 r/w Section 438/442 BNSS, 2023 seeking quashing of FIR No.416 dated 28.10.2024 under Sections 318(4)/319 of BNS, 2023 registered at Police Station Sector 27, Sonepat, Haryana (Annexure P-1) along with all subsequent proceedings arising therefrom on the basis of compromise dated 08.01.2025 (Annexure P2). Learned State counsel, at the outset, on instructions from Investigating Officer submits that the present petition seeking quashing of FIR(supra) on the basis of compromise is only qua one accused, whereas 04 persons have been nominated as accused in the FIR(supra). Further the partial compromise is not permissible in terms of the reference answered by the Division Bench of this Court in CRM-M-48043-2023 decided on 12.11.2024 titled as ‘Rakesh Das Vs. State of Haryana and Another’. In view of the above, present petition is disposed of as such. However, liberty is granted to the petitioner to file a fresh petition on the same cause of action after impleading all the accused persons.
