SECRETARY. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in nature of Writ of Mandamus declaring the action of the respondents No.5 and 6 in not allowing the petitioners discharge his duties as Sangamitra/ (Village Organisation Assistant) and also forcing him to resign to the post of Sangamitra of Ushodhaya Mutually Aided Coop. Village Society Ltd., Chinnagollapalli Village, Gudupalli Mandal., i.e., the respondent No.7 society, without assigning any reason whatsoever, as arbitrary, illegal, colorable exercise of power and contrary to the well established principles apart from being violative of the fundamental rights guaranteed to him under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents No.5 and 6 to continue the petitioner in the post of Sangamithra of the respondent No.7 society and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the respondents No.5 and 6 to allow the petitioner to discharge his duties as Sangamithra (Village Organization Assistant) of the respondent No.7 Society, pending disposal of the above Writ Petition and pass Counsel for the Petitioner:

The Court made the following:
:: ORDER :: The above writ petition is filed to declare the action of respondents 5 & 6 in not allowing the petitioner to discharge duties as VOA in respondent No.7 Society. 2. Heard learned counsel appearing on either side. 3.
Learned counsel for the petitioner would submit that by a resolution dated 12.07.2023, the members of respondent No.7, elected the petitioner to continue as VOA for three more years. However, respondents 5 & 6 are interfering with the petitioner’s discharging duties as VOA.
4. Sri Hari Babu, learned Standing Counsel appearing for respondents 2 to 6, on instructions, would submit that in the place of petitioner, one D. Priyanka was appointed as VOA by respondent No.7 on 12.09.2024.
5. In reply, learned counsel for the petitioner seeks permission to challenge the proceedings before the appropriate firm.
6. Given the facts and circumstances of the case, the Writ petition is
disposed of at the stage of admission with the consent of both the learned counsel, giving liberty to the petitioner to challenge the proceedings dated 12.09.2024, if aggrieved. There shall be no order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
