seeking anticipatory bail. Initially the said crime was registered for the offences punishable under Sections 494, 420 and 506 r/w 34 IPC and Section 3(1)(r), 3(1)(s) and 3(2)(va) of the Scheduled Castes and The Scheduled Tribes (Prevention of Atrocities) Act, 1989. 3. Earlier the petitioner filed petition under Section 482 Cr.P.C. seeking to quash the proceedings in the said crime.
This Court by order dated 28.03.2024 vide Criminal Petition No.2137 of 2024 disposed of the criminal petition directing the police to follow the procedure as contemplated under Section 41A Cr.P.C. as per the guidelines enunciated in Arnesh Kumar v. State of Bihar1. Now, the petitioner filed the present application seeking anticipatory bail. As this Court has already passed orders directing the police to follow the procedure as contemplated under Section 41A Cr.P.C. as per the guidelines enunciated in Arnesh Kumar (supra), no orders are required to be passed even after filing of the charge sheet. The petitioner / A.1 is directed to appear before the concerned Court and cooperate with the trial of the case.
