ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioners/Accused No. 7 or 8 (Number not assigned) for granting of pre-arrest bail in connection with Crime No.54 of 2025 of Steelplant Police Station, Visakhapatnam Commissionerate, registered for the alleged offences punishable under Sections 109 read with 3 (5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’)

The case of the prosecution is that on 25,07.2025, at about 16.00 hours, the complainant went to the school to pick up his daughter, but it was informed that the school timings had been extended up to 19.00 hours for sports activities. Therefore, he went to the lorry yard at B.C. Gate at about 17.30 hours and was talking with his brother Sathish and Ganesh. At that time, the accused and some others rushed to the spot, attacked the complainant with their hands, and one of the accused, Molli Shiva, beat him on the head with a stick, while another accused, Srinu, hit him in the eye with his hand, resulting in bleeding injuries on his head. The complainant then escaped from the spot, went to S.V.S.

3. Mr.Kandregula Leela Hari Prasad, the learned counsel for the petitioner contends that the petitioner is innocent of the alleged offence and has been falsely implicated by the police. It is further submitted that the petitioner is the sole earning member of the family and, he is ready to abide any conditions that may be imposed by this Court, and it is urged to grant pre-arrest bail to the petitioner.

Per contra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor vehemently opposed the grant of pre-arrest bail to the petitioner, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioner is released on pre-arrest bail, there is a strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing, it is urged that the petition be dismissed.

learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record.

6. As seen from the record, there are specific overt acts attributed against the petitioner. Aiiegation against the petitioner/Accused is that he fisted the de-facto complainant, as a result he suffered injuries. Grant of Anticipatory bail is not a license for the commission of an offence, nor it is a shield for a person who has allegedly committed an offence as per the decisions of the Hon’ble Apex Court in Gurbaksh Singh Sibbia v. State of Panjab^ and Sushila Aggarwal v. State of (NCT of Delhi)^. The medical report filed by the learned counsel for the petitioner shows that the health condition of the petitioner is not in alarming position. an Considering the facts arid circumstances of the case, the nature and gravity of the allegations levelled against the petitioner, there are merits for grant of pre-arrest bail to the petitioner. Hence, there are no merits in the Criminal Petition and it is liable to be dismissed.

8. In the result, the Criminal Petition is dismissed. However, as per the request of the learned counsel fcr the petitioner, liberty is granted to the petitioner to surrender before the learned Jurisdictional Court concerned within one (01) week from the date of receipt of copy of this
