302016. ----Petitioner Versus
1. Food Corporation of India through its Chairman and Managing Director, 16-20, Bara Khamba Lane, New Delhi-
110001.
2. General Manager (North Zone), Food Corporation of India, Zonal Office (N), A-2A-2B, Sector 24, Noida (UP) 201301 ----Respondents For Petitioner(s) : Mr. Hemant Kumar Sharma For Respondent(s) : Mr. Narendra Singh Yadav HON'BLE MR. JUSTICE SAMEER JAIN
Judgment 25/03/2025 The present petition is filed assailing the impugned order dated 17/23.06.2016, whereby candidature of the petitioner was rejected for the post of AG-III in Food Corporation of India, despite securing merit.
Learned counsel for the petitioner has submitted that condition No. 1 and 2 under the heading of important information/instruction in the advertisement No. 3/2015 dated 16.02.2015 is arbitrary, illegal and unconstitutional on account of the fact that the same is permitting candidates to apply in one zone only for the said post i.e., either in East, West, North or South.
[2025:RJ-JP:13486] (2 of 2) [CW-9005/2016] It is further submitted that the petitioner has opted for multiple zone in the application form, dehors the said condition, resulting in rejection of petitioners' candidature despite securing merit. Considering the foregoing facts and circumstances of the case, this Court has made the following observations:- (i) That the condition mentioned at page 30 (Annexure-4) categorically states that if any candidate applied in more than one zone, his candidature shall be summarily rejected. The relevant portion of the same is reproduced as under:-
"Candidates can apply only in one zone either north zone or south zone or east zone or west zone or north-east zone as per vacancies, as the examination can be held on same day, if it is found at any stage that a candidate has applied for two or more zones, his/her candidature shall be summarily cancelled. In case of multiple applications, even within a zone the candidature shall be summarily cancelled." (ii) That the petitioner has violated the said condition of the advertisement, and approached this Court after document verification, therefore, relying upon the principle of acquiescence, the petition cannot be entertained. (iii) That at the present stage, if petitioner is permitted, hostile discrimination would be caused to the candidates who were rejected on the akin ground. Accordingly, the present petition is dismissed being devoid of merits. Pending applications, if any, shall stand disposed of.
