Page No.# 2/3 Hussain Ansari under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking bail in connection with Dwarbond P.S. Case No. 49/2025 (G.R. Case No. 1185/2025) under Sections 61(2)/ 310(2)/ 311/ 126(2)/ 351(3)/ 317(2)/ 3(5) of BNS, 2023, read with Sections 25(1)(a)/27(1)/ 27(2) of the Arms Act . 3. Case diary is received and perused. 4. As per the allegation contained in the FIR some unknown persons have committed decoity in the house and shop of the victim and looted certain articles including cash amount, gold ornaments as well as motor vehicles. 5. It is submitted on behalf of the petitioner that he is the VDP Secretary of the village. Reference has been made to Annexure- A, page 12 in this regard and that he has been falsely implicated in this case due to political rivalry. 6. It appears from the record that the petitioner was granted pre-arrest bail in another case by this High Court i.e. in A.B. No. 1980/2025 vide order dated 18.08.2025 and it is the contention of the petitioner that pursuant to the interim protection granted by the Court in the previous case when he has gone to the police station for recording his statement, he was arrested in the present case and despite the serious nature of allegations the police did not seek police remand as reflected in the forwarding report and he was remanded to judicial custody. 7. This Court vide order dated 19.09.2025 granted interim protection to the petitioner with a direction to cooperate with the investigation. 8.
On perusal of the case diary, it appears that the petitioner was arrested on suspicion as he was found loitering in the area. It is stated in the grounds of arrest that he has prior criminal antecedent. However, as far as the present case
Page No.# 3/3 is concerned, there appears to be no incriminating materials so far against the petitioner. 9. Accordingly, the prayer for bail is allowed. The order of interim protection dated 19.09.2025 is hereby made absolute on the same terms and conditions contained in the interim order dated 19.09.2025 itself. 10.
