Today when the petition is taken up for hearing, learned Assistant Public Prosecutor has produced a copy of instructions dated 07.01.2025, of the Sub-Inspector of Police, Ponduru Police Station, Srikakulam District, wherein it is stated that pending the present petition, the Police, after due investigation on 27.04.2023, have filed a charge sheet vide P.R.C.No.1 of 2023 on the file of the Sessions Court, Srikakulam, and the case is in pre-trial stage. 3. In view of the fact that a charge sheet vide P.R.C.No.1 of 2023 has already been filed on 27.04.2023, pending the present petition, learned counsel for the petitioner sought permission of this Court to withdraw the present petition. 4. Permission as sought for is accorded. Accordingly, this criminal petition is dismissed as withdrawn, with a liberty to challenge the aforementioned charge sheet, if at all the petitioner is aggrieved by the same.
