1. Mr. Saha, learned Senior Advocate, appearing for the petitioner, submits that though hearing of two applications were fixed for hearing on repeated occasions, but the same has not yet been taken up for effective hearing. He further submits that 2nd July, 2025 has been fixed for hearing of IA No.540 of 2025, which is an application for setting aside the sale conducted by the Liquidator and the other application being IA No.733 of 2025, which is for holding inspection of a property which is the subject matter of dispute between the parties. Mr. Saha submits that the date of hearing of such applications which has been fixed on 2nd of July, 2025, be preponed by this Court.
2. CO 2105 of 2025 stands disposed of by giving liberty to the petitioner to mention before the National Company Law Tribunal, Bench-II, Kolkata, for preponing the date of hearing. If such an approach is made, the Presiding Officer of the learned Tribunal is requested to consider the urgency involved in the matter and proceed in accordance with law. It is, however, made clear that this Court has
2 not gone into the merits of the claims and counter claims of the respective parties in the aforesaid matter.
3. Parties shall act on the server copies of this order duly downloaded from the official website of this Court.
4. Urgent photostat certified copies of this order, if applied for, be supplied to the parties on compliance of necessary formalities.
