Neutral Citation No. - 2025:AHC:35254-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 4568 of 2025 Petitioner :- Kaish Kumar Singh Respondent :- State Of Up And 5 Others Counsel for Petitioner :- Santosh Kumar Singh Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
1. Heard learned counsel for the petitioner and Sri Paritosh Malviya, learned AGA-I for the State.
2. The present writ petition has been preferred for a mandamus commanding the respondent no. 2 to grant approval for instituting prosecution against the respondent no. 6, who is involved in Case Crime No. 482/2024, u/s 419, 420, 467, 468, 34, 120 IPC, P.S. Kotwali, District Ballia.
3. At the very outset, learned AGA-I raised two-fold objections qua maintainability of the writ petition. Firstly, the petitioner himself is having criminal antecedents of six cases. Secondly, the instant writ petition is not a PIL. As the petitioner is not a aggrieved party, he cannot invoke the writ jurisdiction under Article 226 of the Constitution of India.
4. We have occasion to peruse the record in question and we find the objections so raised by learned AGA-I has force.
5. The writ petition sans merits and is accordingly dismissed. (Prashant Kumar,J.) (Mahesh Chandra Tripathi,J.)
