This Writ Petition has been filed invoking the jurisdiction of this Court under Article 226 of the Constitution of India with a prayer for direction upon the respondents to take immediate action upon the enquiry letter issued to the Vice Chairman, RRDA, Ranchi and to initiate order for demolition of encroachment upon part of the common road as per JRDA Act, 2001, also for issuing a writ in the nature of Mandamus commanding upon the respondents particularly the Chief Secretary, Government of Jharkhand to hold enquiry in respect of ignoring the complaints of the petitioner. The third prayer has been made for issue of a writ in the nature of Mandamus commanding upon the Principal Secretary, Department of Home, Government of Jharkhand to hold an inquiry against the Director General of Police, Jharkhand and its subordinate officers for ignoring the complaint of threatening given by respondent no.8. Further, a prayer has been made in the nature of Mandamus W.P. (Cr.) No.881 of 2023 3 commanding upon the Chief Secretary, Government of Jharkhand to hold inquiry against the Deputy Commissioner, Ranchi in respect of notice issued to the petitioner in respect of forged F.I.R. 3. The petitioner appearing in person through video conferencing submits that in page no. 52 of the writ petition he has mentioned that prior to this writ petition, the petitioner has already filed writ petition being W.P. (C) No. 3981 of 2023 in this Court which is still pending. 4. It is submitted by the learned counsel for the respondent no.8, drawing attention of this Court to copy of the petition of W.P.(C) No. 3981 of 2023 that for identical prayer, the petitioner has already filed W.P.(C) No. 3981 of 2023 which is still pending, hence for the selfsame prayer, this subsequent writ petition is not maintainable. 5. From perusal of the petition of W.P.(C) No. 3981 of 2023, this Court finds that prayer no. (i) of this petition as well as the petition of W.P.(C) No. 3981 of 2023 is exactly the same; except that instead of respondent no.8 who is the private respondent in this writ petition, in the prayer in W.P.(C) No. 3981 of 2023 respondent no.9 has been mentioned because the same private respondent no.8 of this writ petition was arrayed as respondent no.9 in W.P.(C) No. 3981 of 2023 and in this writ petition the respondent no.8 of W.P.(C) No. 3981 of 2023 namely Vice Chairman, Ranchi Regional Development Authority has not been arrayed as a party. So far as the second prayer made in this writ petition is concerned, the same is also identical to the prayer made by the writ petitioner in W.P.(C) No. 3981 of 2023 except that the respondent no.8 as referred in this prayer has been mentioned as respondent no.9 of that writ petition. The third prayer of this writ petition is also word by word same as the third prayer of W.P.(C) No. 3981 of 2023; except that respondent no. 8 has been described as respondent no.9 in W.P.(C) No. 3981 of 2023. So far as the fourth prayer of this writ petition is concerned, the same is word by word same as the prayer no.(v) of W.P.(C) No. 3981 of 2023. 7. Since, for the selfsame relief as has been prayed for by this writ petition, a priorly instituted writ petition being W.P.(C) No. 3981 of 2023 is still pending before this Court; of course in a different roster, this Court is of the considered view that in view of the pendency of W.P.(C) No. 3981 of 2023 which was priorly instituted and for the selfsame relief, which has been prayed for in this W.P.(C) No. 881 of 2023 is not maintainable. 8.
