1. Mr. Manvendra Singh,
learned counsel for the applicant.
2. Mr. Siddharth Bisht, learned A.G.A. with Mr. Himanshu Sain, learned Brief Holder for the State.
3. Present applicant- Sohail Khan @ Sohel, S/o Ninna, is praying for regular bail in relation to FIR dated 02.08.2024 registered as FIR/Case Crime No. 252 of 2024 at P.S. Vikasnagar, District Dehradun wherein the present applicant has been implicated for the offences punishable under Section 65(2) of BNS 2023 read with Section 5(m)/6 of the POCSO Act.

It is argued by the learned counsel for the applicant that applicant is innocent and has been falsely implicated, and furthermore, the charge sheet has already been filed and the trial has been commenced, and, as such, there is no need of custodial interrogation and the applicant is languishing in jail since
03.08.2024. He further submits that parents of the victim have also been declared hostile by the trial court.

On the other side, Mr. Bisht, learned A.G.A. for the State has not disputed this fact that the trial has already been commenced, and, as such, there is no need of custodial interrogation of the present applicant, however, he further submits that merely on the ground that parents of the victim have been declared hostile does not mean that the applicant is not involved in the offence.

learned counsel for the parties and further taking into consideration that the present applicant is languishing in jail since 03.08.2024, and charge sheet has already been filed, and trial is also commenced, therefore, there is no need of custodial interrogation of the applicant, and, as such, this court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant Sohail Khan @ Sohel be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
