THE HON’BLE JUSTICE Dr. V.R.K.KRUPA SAGAR CRIMINAL PETITION No.6480 of 2024 ORDER:
This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), is filed by the petitioner/A.1 seeking anticipatory bail in connection with Crime No.417 of 2024 of Patamata Police Station, Vijayawada City, registered for the offences punishable under Sections 370A(2), 370(3) and Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act. 2. Heard arguments of Sri Ramu Panchumarthi, the learned counsel for the petitioner and the learned Assistant Public Prosecutor for respondent-State. 3. Perused the record. 4. F.I.R. in this case was registered on 27.05.2024. Door No.54-20/6-10, Kanakadurga Gazetted Officers Colony, Gurunanak Colony, Vijayawada was raided and sex workers were rescued and customers were caught. During investigation sex

workers and other witnesses were examined by the investigation agency. 5. The petitioner being arraigned as A.1 seeks pre-arrest bail. The learned counsel contends that he is a married man with children, and he is innocent and he is neither owner nor the tenant in the building that was raided. Based on the confessions of co-accused he is falsely implicated in this case. 6. Learned Assistant Public Prosecutor representing the State very seriously opposed the prayer saying that this petitioner is one who has been running the brothel and organizing this human trafficking. That the witnesses examined by the investigation officer clearly mentioned the name of this petitioner as the one who has been indulging in such immoral and illegal activities. It is further argued that the petitioner has been absconding since the time of registration of crime. 7. This petitioner initially filed Criminal Petition No.4081 of 2024 seeking pre-arrest bail. After recording reasons, this Court declined to grant the prayer and by its order dated 01.07.2024 dismissed the petition. Within days thereafter the petitioner filed Criminal Petition No.4916 of 2024. This Court by order dated

29.07.2024 dismissed the petition with specific observations that the petition did not refer to any change of circumstances. Now by this present third bail petition, the prayer is renewed. A reading of the petition discloses at once that neither additional grounds are pleaded nor change of circumstances mentioned in the bail petition. The nature and gravity of the offences when considered by this Court it is crystal clear that the acts committed by him have a large impact on the public.
Without any merits, the petitioner has been claiming the relief which this Court cannot appreciate. One who is not participating in the legal process is not entitled to seek pre-arrest bail. 8. In the result, this Criminal Petition is dismissed. ________________________
