ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: ‘...to issue
order or direction more particularly in the nature of writ of mandamus under Article 226 of Constitution of India declaring the action of the respondent No. 4 and 5 are evicting the petitioners land an extent of Ac. 1.50 cents in Sy No. 13-7A situated at situated at Kungegowniyur Village, Kuppam Mandal, Chittoor District by laying the road without following land acquisition proceedings is illegal, arbitrary, unjust, contrary to the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and violative of principles of Natural Justice and violation of articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents not to lay the road by disposes or interfere with in the above subject land and pass..’’
2. The Tahsildar, Kuppam, addressed a letter to the learned Government Pleader for Revenue, which is placed before this Court and the same is part of the record. As seen from the proceedings of the Tahsildar, it appears that the subject land is a patta land, and petitioner is in possession and enjoyment of the said land. The authorities have also issued pattadar passbooks and title deeds in favour of the petitioner. Furthermore, the respondentshave neither dispossessed the petitioner from the subject land nor laid any road in petitioner’s property. 3. 4. In view of the assertions made in the letter addressed by the Tahsildar to the learned Government Pleader, the present Writ Petition is disposed of, directing the respondent authorities not to dispossess the petitioner from the
