JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 3 24-06-2025 Heard learned counsel for the petitioner and the State . 2. Petitioner apprehends arrest in a case registered for the offence punishable under section 190, 191 ( 2 ), 191(3) and 109 of the BNS. 3 . As per the prosecution case , informant, namely Ashish Prakash, alleged that he received a call from his friends that a fight between 15–20 unknown accused persons near Diamond Hotel was going on and insisted him to come to the place of occurrence , and upon such information , when informant went to the spot, accused persons fired upon him, due to which one bullet hit the left side of his neck and other on his hydrocele as a result of which he sustained firearm injury and is undergoing treatment. The name of petitioner transpire during course of investigation . No incriminating article has been recovered from the conscious possession of this petitioner. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposes the prayer for bail and submits that during course of investigation , it has come that this petitioner opened fire upon informant due to which informant sustained fire arm injury . 6. Considering the material available on record and the fact that petitioner is alleged to have caused firearms injury to the informant, prayer for pre-arrest bail of the petitioner is rejected.
