Both these bail applications arise out of same police case. Accordingly, they are being disposed of by a common order.
Petitioners have been made an accused in connection with S.T. Case No.- 64/2024, arising out of Maranghada P.S Case No. 31/2023, Corresponding to G.R. Case No. 149/2024, registered under sections 302, 201 and 120B of the Indian Penal Code, pending in the court of learned Sessions Judge, Khunti.
On 18.11.2023, Mother of the informant went missing. Subsequently on 19.11.2023, her dead body was recovered from a place near Baru Buru Hills. FIR was registered against unknown persons.
Learned A.P.P. submitted that the on the basis of confession of co-accused Mahadeo Munda hatchet used in committing murder of the deceased was recovered. He further
submitted that the name of the petitioner Lukin Munda has come in confessional statement. He has also confessed his guilt but nothing has been recovered on his pointing out.
Regard being had to the facts and circumstance of the case; I am not inclined to enlarge the petitioner Mahadeo Munda on bail. Accordingly, his prayer for bail is hereby rejected.
As far as the petitioner Lukin Munda is concerned; I am inclined to enlarge him on bail. Accordingly, he is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Khunti in connection with S.T. Case No.- 64/2024, arising out of Maranghada P.S Case No. 31/2023, Corresponding to G.R. Case No. 149/2024.
