Darakeshwar, learned Sr. PCCG appearing for the respondents. The present writ petition has been filed with a prayer inter alia, for quashing and setting aside the impugned letters dated 06.07.2022 & 19.08.2022 of the DIG(Medical) Composite Hospital and its Office Signal dated 19.08.2022 declining to grant HRA to the petitioner during the period he was undergoing P.G. Course at Jaipur coupled with a prayer for directing the respondents to sanction HRA in favour of the petitioner beyond 180 days as has been done in respect of other similarly situated persons. It has been submitted by Ms. Geetarani Takhellambam,

Page 2 to Central Government employees of the Ministry of Finance, Department of Expenditure, it is provided as under :- ‘6.1.7. In case of Study Leave approved by Government of India, employee shall be eligible for HRA at the place of study without producing certificate mentioned in Annexure III’. It has further been submitted that in terms of the said instructions of the compendium as quoted hereinabove, similarly situated person has been allowed to enjoy HRA while they were undergoing P.G. Course and one such instance is with regard to one Sreenivasu Mamidi, CMO(OG)/2IC in the CRPF vide order dated 10.08.2024 sanctioning the HRA in favour of the said personnel during the entire period of 3(three) years for undergoing the P.G. Course. The
learned counsel submitted that the present writ petition can be allowed by directing the authorities to grant similar relief to the present petitioner. Mr. W. Darakeshwar, learned Sr. PCCG appearing for the respondents, fairly submitted that he has received instructions from the authorities that the present writ petition can be disposed of by granting similar relief as has been granted to Sreenivasu Mamidi, CMO(OG)/2IC of the CRPF vide order dated 10.08.2024. Taking into consideration the submission advanced by the
learned counsel appearing for the parties, this Court is of the considered
Page 3 view that it will be in the interest of justice to issue the following directions:- (i) Respondent Nos. 2, 3 & 4 are hereby directed to grant HRA to the petitioner for the period he has undergone P.G. Course, i.e., w.e.f. 03.07.2018 to 03.06.2021 as has been done in the case of Sreenivasu Mamidi, CMO(OG)/2IC vide order dated
10.08.2024. (ii) The whole exercise should be completed within a period of 4(four) months from today. (iii) It is made clear that the present writ petition has been disposed of on the basis of the submission advanced by the learned counsel appearing for the parties and without touching the merit of this writ petition. With the aforesaid directions, the present writ petition is
