SUNDAR (ORDER) 03.10.2025. Captioned Contempt petition has been filed complaining of breach of an order dated 22.08.2023 made in WP(C) No.561 of 2023. 2. When the captioned matter was last listed (previous listing) on 24.09.2025 following proceedings were made: ‘There is no representation for petitioner either in the physical Court or on the Video Conferencing platform but Mr. Kh. Samarjit, learned DSGI for respondents is ready. 2 However, with the intention of giving an opportunity to petitioner and learned counsel for petitioner, list on 03.10.2025.’ 3. Position is not different today i.e., there is no representation for petitioner but Mr. Kh. Samarjit, learned DSGI for all the respondents is before this Court. In the light of their being no representation for petitioner in two consecutive listings and in the light of the obtaining legal position that petitioner in contempt petition is only an informant and there is no lis in a contempt petition, this Court considered the matter on the basis of available case file and submissions of learned DSGI, 5. Learned DSGI has placed before this Court an order dated 23.09.2025 bearing reference VII 11013/Estate/Saibol Joupi/2025/2781 captioned Mahanideshalaya Assam Rifles, Directorate General Assam Rifles: Shillong and further captioned ‘speaking order’ made by R4 and scanned reproduction of this order is as follows: 6. A careful perusal of the afore referred order dated 22.08.2023 in WP(C) No.561 of 2023 out of which the captioned contempt petition arises, makes it clear that the only directive to the respondents is to consider petitioner’s representations dated 20.03.2023 and 23.03.2023 and make appropriate speaking order. 7. As a speaking order has been mad qua petitioner’s representations, this Court is of the considered view that order dated 22.08.2023 stands complied. 8. Leaving upon the rights and contentions of the contempt petitioner to assail the speaking order if so advised and if so desired, captioned contempt petition is disposed of as closed. 9.
