ORDER: The Criminal Petition has been filed under Section 482 of the BNSS, by the petitioner/A2 for granting of pre-arrest bail in connection with Crime No155 of 2025 of Prohibition and Excise Police Station, Hindupur, registered for the alleged offences punishable under Sections 7 read with 8(b)(i) of the A.P Prohibition Act.

The case of the prosecution in nutshell is that on 21.04.2025 at around 12;40 PM, acting on instructions from the Prohibition & Excise Inspector, Hindupur, the Sub-Inspector and staff conducted raids in Hindupur Town but found nothing. At about 1:20 pm, they raided near Nandi Circle on the NTR Rehamathpur Circle Road and found a man carrying a white polythene bag. Upon spotting the officials, he attempted to flee but was caught by the staff. Upon questioning, the man admitted the bag contained Karnataka liquor. Efforts to secure mediators failed. On inspection, the bag contained 144 (90ml) Haywards Cheers Whisky tetra packs of NDPL. The accused identified himself as Narayana (46), S/o Late Chowdappa, of Ambedkar Nagar, Hindupur (Aadhaar: 6376 4952 7566). He claimed the liquor was given by Raju (25), S/o Nagaraju, from the same locality, who paid him Rs.500 a day to sell it. A sample of one 90ml tetra pack was taken for chemical analysis, properly sealed and labelled. The accused was then informed of the grounds of arrest, taken into custody, and the remaining liquor was seized under a special report.

3. Public Prosecutor. Perused the record. Sri Sujan Kumar, the learned counsel for the petitioner submits that the petitioner has not committed any offence; petitioner was falsely implicated by the police in the crime; petitioner is the sole breadwinner; petitioner would abide by any conditions to be imposed by this Court; and urged to allow the
4. petition. Per contra, Ms. P. Akhila Naidu, the learned Assistant Public Prosecutor, opposed in granting of bail stating that some more material witnesses have to be examined; investigation is not completed; if the petitioner is enlarged on bail, he would not be available for the investigation and he would escape from the clutches of law; and urged to dismiss the bail petition. 5. A perusal of the material on record goes to show that the petitioner herein/A2 was not present at the scene of offence and basing on the confessional statement of A1, the name of the petitioner/A2 is figured in the
6. FIR. In view of above facts and circumstances of the case, this Court is
7. inclined to consider request of petitioner for grant of anticipatorybail. Accordingly, this criminal petition is allowed with the following directions: In the event of arrest of the petitioner, the petitioner shall be enlarged on bail on executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only), with two sureties each
