By means of present petition filed under Article 226 of the Constitution, petitioner has prayed for following relief: "Issue a writ, order or direction in the nature of mandamus for direction upon the respondent authority to consider and decide the claim of the petitioner with regard to the payment of pay grade of Rs. 2800/- to the petitioner considering the judgment rendered in writ- A No. 20255 of 2021 (Kamal Deep Nirala and Others v. State of U.p. and Others) within a short stipulated time period as may be specified by this Court" It is submitted that the controversy is no more res integra in the light of judgment of this Court in the case of Savita Tiwari and Others v. State of U.P. and Others, being Writ A No. 12730 of 2023, decided on 10.10.2023. Learned Standing Counsel submits that the matter can be directed to be examined by the competent authority/ respondent no. 2 in accordance with law . In such above view of the matter, this petition stands disposed of with direction to the petitioner to make comprehensive representation annexing therewith copy of the judgment of this Court in the case of Savita Tiwaria and Others (supra) within a period of four weeks' from today before respondent no. 2 and in the event any such representation is made, respondent no. 2 is directed to examine the same in the light of judgment of Savita Tiwari and Others (supra) and in the event the claim of the petitioner is covered under the said judgment, appropriate decision shall be taken within a further period of two months.
