2025:JHHC:16985 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.7595 of 2024 ------ Sunil Kumar @ Sunil Kumar Yadav, S/o Doman Yadav. … … Petitioner Versus The State of Jharkhand. … … Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Abhay Kr. Chaturvedy, Advocate For the State : Mr. Abhay Kr. Tiwari, A.P.P. ----- 05/ 24.06.2025 Heard the parties. 2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Lawalong P.S. Case No.48 of 2024, for offences under Sections 126(2), 115(2), 117(2), 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The case is presently pending before the Court of learned Chief Judicial Magistrate at Chatra. 3. It is alleged that this petitioner and two others have assaulted the injured with the rod whereas the other two person used lathi. 4. Learned counsel representing the petitioner submits that the petitioner had earlier lodged a case against the informant and others as he was assaulted. 5. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 6. Having heard the parties and after going through the impugned order, I find that there is no injury report before the Court to suggest that what was the nature of the injury. Further, from the 2025:JHHC:16985 entire episode, prima facie I could not find any material to attract the ingredients of Section 109 of the Bharatiya Nyaya Sanhita. All the other offences are bailable in nature. Thus, I direct the petitioner to appear before the concerned Court who will consider the case of the petitioner, considering the observation made hereinabove, and the fact that other co-accused have been enlarged on bail. 7. Accordingly, this Anticipatory Bail Application stands disposed of. (ANANDA SEN, J.) Prashant. Cp-3
