Heard on I.A. No. 01/2024, application under Section 5 of the Limitation Act for condonation of delay in filing the restoration application. 2. On due consideration and for the reasons stated in the application, the same is allowed. Delay of 43 days in filing the restoration application is condoned. 3. Also heard on application for restoration of S.A. No.227/2024. 2 4. On 03.05.2024, Second Appeal No.227 of 2024 was listed for orders on default. For this purpose, two weeks' time was granted to remove the default, failing which, the appeal would be dismissed without further reference to the Bench. 5. Since the default pointed out by the Registry was not removed within stipulated time, the appeal was dismissed. 6. Taking into consideration of the submission and cause shown in the application, I am inclined to restore Second Appeal No.227 of 2024. 7. Prayer for restoration of appeal is allowed and Second Appeal No.227 of 2024 is restored to its original number. 8. The MCC is accordingly allowed and disposed of.
