4. This court on 08.01.2019, granted interim suspension of the impugned order.
5. The unofficial respondent is aged about 83 years at the time of filing of the writ petition. It is argued that unable to bear the relentless harassment, pressurizing the unofficial respondent to transfer his properties against his will to the petitioner herein, the unofficial respondent and his wife were compelled to stay in a old age home. During the pendency of the writ petition, the wife of the unofficial respondent died. The fact remains that the unofficial respondent’s aged wife died
6. during her last days, she was forced to live out of their home, died out of her home thereby both, the aged unofficial respondent and his wife were unjustly deprived of their rightful living, and deprived of their fundamental right to live. Having regard to the objects of the which includes a decent living. Maintenance and Welfare of Parents and Senior Citizens Act, 2007, the authorities under the Act, are under an obligation to see that the senior citizens are protected and they are able to lead a normal life. The finding of fact arrived at by both the authorities is that the subject property is self acquired property of the unofficial respondent purchased vide registered sale deed in the 1971 and the petitioner was sufficiently provided by his father, the unofficial respondent herein. Having regard to the findings arrived at by both the parties, there is no infirmity in the order of the Tribunal and the appellate authority and I do not find any perversity from the order of the 2"'^ respondent, which was confirmed by the 1®^ respondent. With the above observation, the writ petition is dismissed. There
