Present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) praying for quashing of FIR No.354 dated 14.12.2015 (P-1), under Sections 406, 420, 467, 468, 471 and 120-B of the Indian Penal Code, 1860, registered at Police Station Baldev Nagar, District Ambala & Final Report/Challan dated 05.06.2016 filed under Section 173(2) of Code of Criminal Procedure, 1973 (for short, ‘Cr.P.C.') along with all consequential proceedings arising therefrom.

Learned counsel after arguing for some time, on instructions, submits that he wishes to withdraw the present petition with liberty to raise all his pleas before learned trial Court, at appropriate stage(s).

Since report under Section 173 of Code of Criminal Procedure, 1973, was present way back on 05.06.2016, therefore, this Court while invoking the provisions of Section 529 of BNSS, deems it appropriate to direct learned trial Court to proceed in the matter expeditiously, without granting unwarranted adjournments to either of the parties.
6. Copy of this order be sent to learned District and Sessions Judge, Ambala, for information.
7. It is further clarified that above observations be not construed as an expression of opinion on merits of the case, in any manner.
