Heard learned counsel for the applicant and learned standing counsel for the opposite party. Pursuant to earlier order of this Court an affidavit of compliance has been filed which is taken on record. An application has also been filed to recall the order dated 15.4.2025. Sri R.K.Ojha, learned ACSC submits that payment of salary to the applicant from the date of interim order has already been made which has been duly endorsed by learned counsel for the applicant. He further submits that order of the writ Court has been complied with, therefore, the order dated 15.4.2025 may be recalled. However, considering the facts and circumstances of the case, I find that no willful disobedience of the writ Court order is made out and the order dated 15.4.2025 is recalled. Notice issued to the opposite party is discharged. The contempt application is consigned to record. However, it is made clear that the applicant shall perform his duties diligently and his salary will be paid month to month. In the event the salary is not paid to the applicant, the applicant will be at liberty to move an appropriate application before this Court.
