ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the BharatiyaNagarik Suraksha Sanhita, 2023 1 seeking to enlarge the Petitioner/Accused on bail in S.C.No.60 of 2025 on the file of the learned Special Judge for Speedy Trial of Offences under Protection of Children from Sexual Offences Act, 20122, Vijayawada in Crime No.0 of 2024 of Kondepi Police Station, Prakasam District, registered against the Petitioner/Accused herein for the offences punishable under Sections 64(2)(m), 65(1) of the Bharatiya Nyay Sanhita, 20233, section 6 of the Protection of Children from Sexual Offences Act, 20124.
2. Heard the learned counsel for the petitioner, legal aid counsel for the 2nd respondent and the learned Assistant Public Prosecutor. Perused the record.
3. Sri M. Srinivasa Rao, learned legal aid counsel for the 2nd respondent, while adopting the arguments advanced by the learned Assistant Public Prosecutor, opposed to grant bail to the petitioner.
4. As seen from the record, the allegation against the petitioner is that he committed an offence punishable under Section 6 of ‘the POCSO Act.,’ against his own sister who was aged about 16 years 7 months at the time of

the alleged offence. The allegations levelled against the petitioner are not only inhuman but also against the ethical values of the society. After thorough investigation the police have filed charge sheet. The case is number as S.C.No.60 of 2025. The accusation is well founded. There are no merits in the petition. Hence, the request for enlarging the petitioner on bail is not found convincing and reasonable.
5. Considering the facts and circumstances of the case, the nature and gravity of the allegations leveled against the petitioner/Accused, this Court is not inclined to enlarge the petitioner/Accused on bail.
6. In the result, the Criminal Petition is dismissed.
