Ibotombi, learned senior counsel assisted by Ms. Y. Jinita, learned counsel for the petitioners; Mr. Th. Sukumar, learned Government Advocate for the State respondents; Mr. I. Lalitkumar, learned senior counsel assisted by Mr. N. Khelemba, learned counsel for respondent No. 4; and Ms. Kamei Landumshinlu, learned counsel for respondent No. 5. [2] In the connected writ appeal, i.e. MC(WA) No. 85 of 2025 vide order dated 02-09-2025, the writ appeal arising out of the interim order from the present writ petition has been settled on the terms that the petitioners- students will pay a sum of Rs. 4,00,000/- per year as tuition fees or Rs. 2,00,000/- per semester till the completion of their MBBS Course. The relevant para of the said order is reproduced as under:— “Mr. N. Ibotombi, learned senior counsel appearing for the appellants and Mr. HS Paonam, learned senior counsel for the respondent No. 4 jointly submitted that the present arrangement of the payment of tuition fees in respect of the present appellants in terms of the earlier interim order passed by this Court be continued WP(C) No. 158 of 2023 till they complete their MBBS Course and that the appellants may not claim from the respondent No. 4 the early excess payment made by them. It is also stated by Mr. N. Ibotombi, learned senior counsel appearing for the appellants that respondent No. 4 may not also claim from the appellants any tuition fees except in terms of the direction given earlier by this Court. Considering the submissions advanced by the learned counsel appearing for the parties, we are of the considered view that it will be in the interests of justice to dispose of the present appeal by making absolute the earlier interim order passed by this Court on 24.08.2023 in W.A. No. 53 of 2023. Ordered accordingly. Consequently, the W.A. No. 53 of 2023 and all the connected applications stand disposed of.” [3] In terms of the order dated 02-09-2025 passed by the Division Bench of this Court in MC(WA) No. 85 of 2025, the parties in the mediation proceedings dated 03-10-2025 have amicably settled on the ground that the petitioners-students will pay a sum of Rs. 4,00,000/- per year or Rs. 2,00,000/- per semester till the completion of their on-going MBBS course. The mediation report is reproduced as follows:— “MEDIATION REPORT Date of Report: 03-10-2025 Dates of Mediation sessions: i. 29-08-2025 ii. 02-09-2025 iii. 16-09-2025 iv. 19-09-2025 v. 26-09-2025 Venue of Mediation: High Court Mediation Centre, Imphal. This report is being submitted pursuant to the referral order dated 18-08-2025 passed by the Hon’ble High Court of Manipur in WP(C) No. 158 of 2023, referring the matter for mediation. WP(C) No. 158 of 2023 The mediation sessions were attended by: i. All the petitioners present in-person. ii. Smt. Dhaneshori, OSD representing R-1 and R-2 along with authorized officials. iii. The respondent No. 4 being represented by its counsel Keisham Melody. Nature of dispute: Payment of tuition fees. Mediation sessions were conducted on 29-08-2025, 02-09-2025, 16-09-2025, 19-09-2025 and 26-09-2025. All parties were given full opportunity to present their issues and explore settlement possibilities. Subsequently the parties reached an amicable settlement on the following points as mention below: i. As decided by the Division Bench of the Hon’ble High Court in MC(WA) No. 85 of 2025 (Ref: WA No. 53 of 2023) dated 02-09-2025, the petitioners will pay Rs. 4,00000/- (rupees four lakhs) as annual tuition/course fees or Rs. 2,00000/- (rupees two lakhs) per semester till their wards complete their MBBS Course to Shija Academy and Health Science, i.e., R-4 herein. ii. The petitioners will not claim or demand from the R-4 any tuition fees given earlier in excess to the above agreed/settled amount of Rs. 4,00000/- (rupees four lakhs) per annum. iii. The writ petition can be closed in view of the above mentioned terms agreed upon by the parties. As settlement have been reached on the above mentioned agreement, the matter is being referred back to the Hon’ble High Court of Manipur for further proceedings as per law. WP(C) No. 158 of 2023 [5] This Court has perused the material on record specially the order dated 02-09-2025 passed by the Division Bench and the mediation settlement proceedings dated 03-10-2025. The writ petition is disposed of in terms of the mediation proceedings dated 03-10-2025. [6] Pending application, if any, stands disposed of. [7] Interim order merges with the final order.
