Sharma, Adv. HON'BLE MR. JUSTICE ANAND SHARMA Order 25/04/2025 1. In the instant writ petition, the petitioner- Secretary, Rajasthan Medicare Relief Society, Primary Health Center, Sirsi Road, Jaipur & another have laid a challenge to the order dated 22.04.2024 passed by the competent authority under Payment of Wages Act, 1936 as well as order dated 15.02.2021 passed on an application under the aforesaid Act. 2. On putting a specific query, it has been admitted by both the parties that the impugned orders are appealable under the Payment of Wages Act, 1936. 3. The petitioner has utterly failed to point out any manifest jurisdictional error or even violation of principles of natural justice in passing the impugned orders, therefore, this Court finds no ground to invoke extraordinary jurisdiction of this Court under [2025:RJ-JP:17616] (2 of 2) [CW-14533/2024] Article 226 of the Constitution of India by bypassing the alternative remedy of appeal. 4. However, the petitioner is at liberty to challenge the impugned orders before the Appellate Authority. The Appellate Authority shall also take care of the provisions with regard to the limitation in light of the fact that the instant writ petition has been filed by the petitioner before this Court. 5. The petitioners shall also be at liberty to raise all the questions and legal objections available to them under the law. 6. Accordingly, the present writ petition is disposed of. 7. Stay application and all other pending application(s), if any, also stand disposed of. (ANAND SHARMA),J DIVYA /222
