JUDGMENT
Since common questions of fact and law are involved in these petitions, therefore, they are clubbed together and are being heard & decided by a common judgment. However, for the sake of 1
2025:UHC:8184 brevity, facts of Writ Petition (S/S) No. 205 of 2025 alone are being considered and discussed. The relief sought in Writ Petition (S/S) No. 205 of 2025 are as follows:-
“i. Issue a writ order or direction in the nature of certiorari quashing the letter dated 13th February 2025 (Annexure No. 10) as being contrary to the joining letter dated 06th February 2025 (Annexure No. 7) pursuant to which the petitioner had already joined on the post of munsarim in the Permanent Lok Adalat on 06th February (see Annexure No. 8).
ii. Issue a writ order or direction in the nature of certiorari to quash the letter dated 13th February 2025 (Annexure No. 11) as issued to Chairman Permanent Lok Adalat by the Uttarakhand State Legal Services Authority wrongly relying on the interim orders in WPSS 2130 of 2023 and WPSS No. 2134 of 2024 where no such direction was passed to stop the appointment of the present petitioner.
iii. Issue a writ order or direction in the nature of mandamus commanding the respondents Permanent Lok Adalat to reinstate the petitioner immediately and with full wages.”

Petitioner participated in a selection held by Uttarakhand Subordinate Service Selection Commission for appointment to ministerial positions in Permanent Lok Adalat. On the recommendation of the selecting body, he was offered appointment as Munsarim in the pay scale of `29,200-92,300/- (Level-5) vide order dated 06.02.2025, issued by Chairman, Permanent Lok Adalat, Dehradun. However, he was not permitted to discharge duties as Munsarim after 13.02.2025 because of the interim order passed in WPSS No. 2130 of 2023 and 2

Learned counsel for the petitioners submits that the contract employees engaged through outsourcing against the vacancies in question challenged the advertisement, whereby selection process was initiated and in those writ petitions interim orders were passed in favour of the contract employees.

Since, the appointments offered to the petitioners were cancelled in deference to the interim orders passed in WPSS No. 2130 of 2023 and WPSS No. 2134 of 2023 and those writ petitions have been decided by an order of even date, against the contract employees, therefore, there is now no legal impediment in permitting the petitioners to join duty on the posts against which they were selected and appointed.

Accordingly, the writ petitions are allowed, the cancellation orders dated 13.02.2025, issued by Chairman, Permanent Lok Adalat, Dehradun are set aside and the competent authority is directed to appoint the petitioners as per their ranking in the merit list.
