The present petition has been filed seeking a direction to respondent No. 2, the Tehsildar Tamkuhi, District Kushinagar, to consider and decide the application/representation dated 02.01.2023, which according to the counsel for the petitioner is under Section 38 of the U.P. Revenue Code, 2006, within a stipulated time period. Counsel for the State-respondent(s) submits that the controversy which is sought to be raised by means of the aforesaid representation would not strictly fall within the ambit of Section 38 of the U.P. Revenue Code, 2006, therefore, the direction as has been sought by the petitioner cannot be granted. Counsel for the petitioner, at this stage, submits that he does not wish to press the petition and that the petitioner would move an appropriate application before the concerned State authority, for redressal of his grievances.
