[2025:RJ-JP:33645] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 10556/2025 Saroj W/o Premchand, R/o Dera, Police Station Reni, District Alwar (Raj.) (At Present Accused Petitioner Confined In Central Jail Alwar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Bheem Sain Bairwa For Respondent(s) : Mr. N.S. Dhakar, PP Mr. Tapesh Agarwal, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 22/08/2025 1. The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.106/2025 registered at Police Station Raini, District Alwar for the offences punishable under Sections 103(1) & 3(5) of Bharatiya Nyaya Sanhita (in short, ‘BNS’), 2023. After completion of investigation, police filed charge-sheet in this matter for the offences punishable under Sections 103(1), 127(2) & 3(5) of BNS, 2023. 2. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He submits that the accused- petitioner has not been named in the FIR. During investigation, no specific role or allegations have been attributed to her and omnibus allegations have been levelled against her. She is female and after completion of investigation, charge sheet has been filed [2025:RJ-JP:33645] (2 of 2) [CRLMB-10556/2025] in the court concerned. She is in custody since 11.04.2025 and trial will take considerable time in its conclusion. Further, no recovery is to be made from the petitioner and therefore, no fruitful purpose would be served by keeping the petitioner behind the bars. 3. Learned Public Prosecutor opposes the submissions made by counsel for the petitioner. He submits that there is serious allegations against the petitioner that she along with other co- accused persons gave mercilessly beatings to deceased Dheeraj with lathis due to which he sustained grievous and dangerous injuries and ultimately died in hospital. 4. I have considered the contentions. 5. In the instant case, serious offences punishable under Sections 103(1), 127(2) and 3(5) of BNS are found to be proved against the petitioner during investigation. Charge sheet has been filed and trial is at initial stage. Thus, having regard to the facts and circumstances of the case and considering the arguments advanced by learned counsel for both the sides as also looking to the gravity of offence and nature of allegations attributed to the petitioner in the charge sheet, I am not inclined to enlarge the petitioner on bail. Accordingly, this bail application is dismissed. 6. Accordingly, this bail application is dismissed. 7. The observations made hereinabove are only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J CHARU SONI /109
