GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the official respondent No.5 in not proceeding with investigation and filing charge sheet in FIR No. 361 of 2024 for the offences U/s 115(2), 2 324(4), 351(2), r/w 3(5) BNS on the file of the Pedakakani Police Station, Guntur District as illegal, arbitrary, unconstitutional and contrary to the provisions of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) and consequently direct the official respondent No.5 to complete the investigation and file charge sheet in FIR No. 361 of 2024 for the offences U/s 115(2), 324(4), 351(2), r/w 3(5) BNS on the file of the Pedakakani Police Station, Guntur District.” 2. Ponnekanti Mallikarjuna Rao, learned counsel for the Petitioner would submit that the Police are not properly investigating Crime No.361 of 2024 on the file of Pedakakani Police Station, Guntur District and have not concluded the investigation and a direction may be given to the Police to conclude the investigation and file charge sheet. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of directing the Police to conclude the investigation in Crime No.361 of 2024 on the file of Pedakakani Police Station, Guntur District and file a report in accordance with law, within a period of three months from the date of receipt of copy of this order. There shall be no order as to costs.
