The petitioner has been made accused in connection with Bindapathar P.S. Case No.64 of 2023, for the offences registered under Sections 302, 307, 147, 149, 323, 325, 506 and 120B of the Indian Penal Code, pending in the court of learned Principal Sessions Judge, Jamtara. On 10.09.2023 at about 4:30 P.M., the petitioner alongwith co-accused persons are said to have assaulted the father-in-law, husband and mother-in- law of the informant causing injury. It is alleged that subsequently, father-in- law of the informant was again assaulted due to which he succumbed to his injuries. It was submitted that there is no allegation against the petitioner that he had assaulted the deceased. It is only alleged that he had assaulted the mother-in-law of the informant. It was further submitted that on similar facts co-accused Nanigopal Gorain @ Noni Gopal Gorai has been granted bail by Hon'ble Supreme Court. From perusal of order passed in I.A. No.106739 of 2024 by the Hon'ble Supreme Court, it appears that Hon'ble Supreme Court has granted bail to co-accused on the ground that he has not caused injury to the deceased. The case of the petitioner stands on similar footing. In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Principal Sessions Judge, Jamtara, in connection Bindapathar P.S.
