Petitioner is aggrieved by the fact that the representation made to the Officer-in-Charge, Haripal Police Station was not considered. Learned advocate for the State has submitted a report. Report reflects that the Civil Judge (Junior Division), 2nd Court, Chandannagar is in seisin of Title Suit No. 336 of 2018. Whenever informations have been furnished the same has been reduced in General Diary Entry and since the dispute and difference between the parties were found to be affecting the breach of the peace and tranquility, police authorities have drawn up proceeding repeatedly under Section 126/135 of the BNSS. Learned advocate for the private respondents submits that the private respondents have also preferred a Civil Suit being T.S. 212/2025 and the same is pending before the Civil Judge, (Junior Division), 2nd Court at Chandannagar. 2 Having considered that the police authorities are well aware regarding the dispute and difference between the parties, I am of the view that in case the petitioner faces inconveniences and the Civil Court being already in seisin of the issue, petitioner would approach the Civil Court with necessary prayers. If the Civil Court passes any direction, police authorities would see to that the same is respected and obeyed. In case there is inconvenience faced by the police authorities in implementing the Civil Court’s order necessary report be submitted before the Civil Court regarding inconveniences faced by the police authorities. With the aforesaid observations WPA 13418 of 2025 is disposed of. Report so submitted by the State be kept with the record. Copy of the report be handed over to both the parties. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
