[2025:RJ-JP:437] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 10335/2024 Siddharth S/o Viresh, R/o Plot No. 2581/2, M.c.c.a. Block, 4 Main, 4 Cross Deven Gere, P.s. Vidhya Nagar, Dist. Dev Nagre, Karnatak. (At Present Confined In Central Jail Kota). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Amit Dadhich For Respondent(s) : Mr. S.R. Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 03/01/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.330/2024 registered at Police Station Gumanpur, District Kota City for the offence(s) under Sections 318(4) & 316(2) of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the entire amount was deposited in the account of Akshay Suresh and accused-petitioner has not received any money from the complainant in his bank account. There is no inducement on the part of the petitioner. The complainant himself in the FIR has stated that Akshay Suresh called him from Bangalore and stated that the amount be deposited in his account. The matter is exclusively triable by Magistrate and charge-sheet [2025:RJ-JP:437] (2 of 2) [CRLMB-10335/2024] has already been produced before this Court. There are no criminal antecedents against the petitioner and the accused- petitioner is in custody since long and trial/investigation of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor vehemently opposes the bail application. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by counsel for the petitioner and taking into note that the petitioner is in custody since long and the matter is exclusively triable by Magistrate, thus, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner- Siddharth S/o Viresh in connection FIR No.330/2024 registered at Police Station Gumanpur, District Kota City, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
