Fayaz Ali For R6 : No Appearance O R D E R The petitioner has filed this writ petition, to issue a Writ of Mandamus, directing the 2nd respondent to pass final order in proceedings vide Na.Ka. D3/277/2018 dated 23.01.2018. 2. The case of the writ petitioner is that the petitioner Waqf is a surveyed and notified Waqf. The Waqf owned several properties and one such property measuring an extent of 4.07 acres in Survey No.159/2, Patta No.6 situated at Arapakkam Village, Wallajah Taluk, Vellore District. The erstwhile hereditary muthawalli who was managing the Waqf property illegally executed a Will in favour of his children and they had alienated the Waqf property as against the Waqf Act. W.P No.6286 of 2019 his name for the property measuring an extent of 1.50 acres and tried to interfere with the possession of the waqf property. Therefore, the petitioner sent several representations to the 1st and 2nd respondents to restore the patta in the name of the petitioner and to protect the waqf property. The 2nd respondent sent a summon to the petitioner dated 23.01.2018 to appear before him. The petitioner also appeared before the 2nd respondent along with all relevant documents and after completion of enquiry, order was reserved. However, till date no order has been passed by the 1st and 2nd respondents. Hence the present writ petition is filed with the above said prayer. 3. However, the learned counsel appearing for the petitioner would fairly submit that already, the private respondent who possess patta in his name filed a suit in O.S No.69 of 2019 on the file the Waqf Tribunal, Chennai and the petitioner is also a party to the suit proceedings. 4. In view of the same, this Court is inclined to grant permission to the petitioner to canvas all those points before the Waqk Tribunal, Chennai. If the petitioner succeeds in the suit, liberty is granted to the petitioner to make a fresh representation for mutation of records before the Revenue Officials.
