The present Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (in short,
“Sanhita, 2023”) has been filed by the applicants seeking anticipatory bail under Sections 221, 238, 318(4), Section 61(2) of the Bharatiya Nyaya Sanhita, 2023, Section 4 read with Section 21 of the Mines and Minerals (Development and Regulation) Act, 1957 in Case Crime No.40 of 2024, registered at police station Kalsi, District Dehradun.
2. Heard Mr. Mayank Joshi, learned counsel for the applicants and Mr. G.S. Sandhu, learned Additional Advocate General assisted by Mr. Deepak Bhardwaj, learned Brief Holder for the State.
3. Mr. Mayank Joshi, Advocate, has requested on instruction to permit the applicants to withdraw the present Application, filed under Section 482 of the Sanhita, 2023 with liberty to file a fresh Application, under Section 482 of
2025:UHC:1578 the Sanhita, 2023, with better particulars.
4. The said request has not been opposed by the State.
5. The present Application, filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is dismissed as withdrawn granting liberty to file a fresh Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, as prayed, but in accordance with law.
