2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 354D of the Indian Penal Code and sections 67/67A of the IT Act.

As per the prosecution case, petitioner hacked mobile phone of the informant and made viral her morphed obscene photos via Whats app. Petitioner continued to send such content to her family members. He also attempted to defame her and obstruct her marriage possibility by making these images and videos viral through various numbers.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is hardly believable that mobile phone cannot be hacked in the manner stated in the FIR by sending OTP and similar objectionable photos and videos cannot be prepared by non-existant photos and videos. There is no allegation that any pair photos of informant with petitioner was made viral on the social media. Petitioner is a student pursuing Teachers Training Course. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes prayer for
Patna High Court CR. MISC. No.20607 of 2024(6) dt.30-04-2025 2/2 bail.
6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Patna in Patna Cyber Police Station FIR No. 68 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
