In view of the order proposed to be passed herein, no useful purpose would be served by putting the private respondent to notice and keeping this petition pending before this Court. However, in case the private respondent feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. The instant writ petition has been filed by the petitioner with the following prayer:- "To issue a writ, order or direction in the nature of mandamus directing the Respondent No.2 or any other transferee court to consider and decide the Restoration/Recall Application dated 4.10.2024 filed in the Mutation proceedings vide Case No. T2024 5440307287 (Smt. Arpita Devi and another vs. Awdhesh Singh) and Case No. T202305440309144 (Smt. Prem Sheela Vs. Awdhesh Singh) against the order dated 3.10.2024 and 15.12.2023 respectively. " 4. The matter is pending before the Court below since 2024 and considerable time has already been lapsed but till date no final decision has been taken in the matter. 5. In the facts and circumstances of the case, the present petition is disposed of directing the court concerned to decide the aforesaid case/suit strictly in accordance with law most expeditiously and preferably within a period of three months from the date of production of certified copy before the Court below but without granting unnecessary adjournment unless there is no legal impediment.
