ORDER: The Criminal Petition has been filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.’) / Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accu sed No. 1 on bail in Crime No.35 of 2023 of Yellamanchili Police Station, Anakapalle District, registered against the Petitioner/Accused No.1
Dr.YLR, j Crl.P.No.8264 of 2025 Dated 20.08.2025 herein for the offences punishable under Sections 302 and 201 of Indian Penal Code, 1860 (for brevity ‘the I.P.C’).
2. The case of the prosecution is that, on 22.02.2023 at about 09:00 hours, the complainant received information regarding an unidentified female dead body found near the premises of Natural Food Company, beside BPCL Petrol Bunk, within the limits of Yerravaram Revenue Division. Immediately receiving the information, the complainant proceeded to the spot and found the dead body of a female, aged about on 25 30 years. The face of the deceased could not be recognized as she was partially burnt, and the body was in a decomposed state with insects on her face. The deceased was wearing black leggings and a blue-coloured top with a gold-coloured butterfly design. Thereafter, the complainant lodged a report at Yellamanchili Town Police Station requesting necessary action.
3. Mr. Deva Deepak Anirudh, the learned counsel for the petitioner contends that the petitioner is innocent of the alleged offence. It is further submitted that the petitioner is the sole earning member of the family and, therefore, his incarceration would cause undue hardship to his dependents. The petitioner undertakes to strictly adhere to conditions that may be imposed by this Court. In light of the foregoing any

submissions, learned counsel prays that the present petition be allowed in the interest of justice. Per contra, Ms.P.Akhila Naidu, the learned Assistant Public
4. Prosecutor vehemently opposed the grant of bait to the petitioner. submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioner is released on bail at this stage, there is a strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law,and it is urged to dismiss the petition. 5. Assistant Public Prosecutor. Perused the record. As seen from the record, there are serious allegations against the
6. petitioner/Accused No.1. It is alleged that he had taken the deceased, a young woman aged about 22 years by name Divya, on a motorcycle, which was witnessed by L.Ws.11 and 12. Thereafter, Accused No.1, with the assistance of the other accused, poured petrol on Divya and set her on fire, thereby causing her death. The investigation is still pending and some more witnesses are yet to be examined. It is also noted that there is another adverse antecedent against the petitioner, as a case under

7. against the petitioner, this Court is not inclined to enlarge the petitioner on bail. Hence, the petition is liable to be dismissed. In the result, the Criminal Petition is dismissed.
