Heard the parties.
Apprehending his arrest in connection with Lohardaga Mahila P.S. Case No.08 of 2024 instituted under Sections 376(2) (n), 493, 417, 313, 323, 341, 504 and 506/34 of the I.P.C., the petitioner has moved this Court for grant of privileges of anticipatory bail.
Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that petitioner was in love with the victim and established physical relationship with the victim and promised marrying her and the other allegation against the petitioner is that petitioner committed miscarriage of the child of the victim and solemnized marriage with the victim in the Temple but did not agree for the social marriage.
Learned counsel for the petitioner and learned counsel for the informant drawing attention of the court towards I.A. No.1846 of 2025 supported with the separate affidavits of the parvikar of the petitioner as well as victim of the case, submits that therein it has categorically been mentioned that matter has been settled between the parties and petitioner and the victim are living together as a husband and wife, therefore, the victim does not want to proceed with the case. It is further submitted that petitioner has no criminal
antecedent as mentioned in para-9 of the anticipatory bail application. It is further submitted that the petitioner undertakes to co-operate with the investigation of the case and to keep and maintain the victim with full honour and dignity as his lawful wife hence, the petitioner be given the privileges of anticipatory bail.
Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within six weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lohardaga in connection with Lohardaga Mahila P.S. Case No.08 of 2024 with the condition that he will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the pendency of the case and also to keep and maintain the victim with full honour and dignity as his lawful wife and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
In view of the disposal of the instant Anticipatory Bail Application, I.A. No.1846 of 2025 stands allowed accordingly.
