Heard Mrs. Th. Babita, learned counsel appearing for the petitioners.
The present contempt case has been filed for alleged wilful and deliberate disobedience of the directions given by this court in its order dated 30-05-2025 passed in WP(C) No. 439 of 2025. The directions given by this court are as under:- (i) The respondents are at liberty to proceed with the recruitment process pursuant to the impugned Notification dated 13-05-2025, however, in respect of the 20 (twenty) posts presently held by the petitioners, it should not be filled up without the leave of this court; (ii) It is made clear that if the posts held by the petitioners are not included in the impugned notification, the respondents can approach this court for modification of this order; and (iii) Pendency of this writ petition will not bar the authorities from considering the case of the petitioners in terms of earlier directions given by this court.”
The case of the petitioner is that despite the said interim order passed by this court, the respondents have issued a Notice dated IN. 2

24-09-2025 and 30-09-2024 for holding Written Test Examination in connection with the impugned Advertisement. According to the petitioners, the act of the respondents amounts to committing wilful and deliberate disobedience of the directions given by this court and as such, they deserves to be punished under the Contempt of Courts Act.
On examination of the directions given by this court, it is crystal clear that this court has never restrained the authorities from proceeding with the recruitment process. In fact, liberty was given to the respondents to proceed with the recruitment process pursuant to the impugned Notification dated 13-05-2025 and as such, this court is of the considered view that any act of contempt is made out. Accordingly, the contempt case is hereby closed.
