The instant petition for contempt has arisen out of an order no. 6 dated 22.11.2022 whereby upon hearing the counsel for the petitioners as well as counsel for the State the Court had directed to the petitioner to withdraw the instant writ petition filed by the petitioner with a liberty to approach before the Collector under section 18 & 30 of the Land Acquisition Act, 1894 who will dispose of the matter in accordance with law but District Land Acquisition Officer has not passed any order till date as per direction given by this Hon'ble court on 22.11.2022 passed in WPC No. 5381/2019. 2. When the Respondent no.4 did not pass any order on the objection/application filed by the petitioner under section 18 & 30 of the Land Acquisition Act, 1894 then the petitioner filed another writ application before this Hon'ble court which was registered as WPC No. 173/2024 and when the matter was taken up on 14.10.2024, the Hon'ble Court upon hearing the counsel of the parties did not entertain the instant writ application. However, the Hon'ble Judge was pleased to give liberty to the petitioner to prefer a contempt application seeking initiation contempt proceeding against the respondent no.4. 3. In pursuance of order dated 12.09.2025, Mr. Krishna Kanhaiya Rajhans, the District Land Acquisition Office, Ranchi is present before this Court and 2025:JHHC:28343 2 Cont. Case (C) No. 558 of 2025 statement has been made that the dispute raised under Section 18 of the Land Acquisition Act, 1894 has already been referred to the competent civil court and the letter dated 12.09.2025 has been produced before this Court suggesting the same. 4. In that view of the above, now the petitioner has remedy to approach the competent civil court before whom the reference has been made. 5. Accordingly, the present contempt petition stands disposed of giving liberty to the petitioner to pursue his case and raise all the points before the competent civil Court where the matter has been referred. 6. With above observation and direction, the present contempt petition stands disposed of. 7. Personal appearance Mr. Krishna Kanhaiya Rajhans, District Land Acquisition Office, Ranchi is, hereby, dispensed with. 8. Office is directed to kept on record the Letter dated 12.09.2025.
